Legal Tussle: Court Fixes Final Date for ₦5 Billion DSS vs. SERAP Suit

In an update published by Channels TV, the High Court of the Federal Capital Territory has scheduled February 19, 2026, for the adoption of final addresses in the ₦5 billion defamation lawsuit filed by the Department of State Services (DSS) against the Socio-Economic Rights and Accountability Project (SERAP). The suit stems from allegations made by SERAP that DSS operatives “invaded” their Abuja office, a claim the security agency dismisses as false and damaging to its reputation. The court proceedings have reached a critical stage after SERAP concluded its defense.

Reporting by Premium Times indicates that during the cross-examination, SERAP officials admitted to using strong language such as “intimidation” and “harassment” in their public statements. The DSS argues that these descriptions wrongly depicted a routine “housekeeping” visit to establish relations with the organization’s new leadership.

The claimant asserts that SERAP’s widely reported allegations led the international community to believe the Federal Government was using security agencies to stifle civic space.

Validation from Daily Post shows that the outcome of this case is being closely watched by human rights groups and legal experts.

Tribune Online noted that “the court’s decision will set a significant precedent for how NGOs interact with state security agencies” and the boundaries of public criticism.

If the court finds SERAP liable, the hefty ₦5 billion claim could significantly impact the organization’s ability to operate in Nigeria.

Echotitbits take:

This case is a proxy battle for the freedom of expression and the limits of institutional reputation. A victory for the DSS could chill the vocal advocacy of other NGOs, while a victory for SERAP would embolden civil society to continue its watchdog role. The “defamation” angle is a sophisticated legal tool being used here to navigate the sensitive ground of state-citizen relations.
