Buhari Breaks Silence on Magu, Says Suspended EFCC Acting Chairman Not Above the Law

President Muhammadu Buhari Saturday broke silence on the travails of the suspended Acting Chairman of the Economic and Financial Crimes Commission (EFCC), Ibrahim Magu.

The President explained that the guiding principle of his administration is that there are no sacred cows, adding that when allegations are made against the chief executive officer of an institution, the chief executive officer has to step down from his post and allow for a transparent and unhindered investigation.

Buhari noted that a series of documented allegations were made against EFCC under the leadership of Magu, which led to the constitution of an investigative panel in compliance with the extant laws governing the convening of such a body.

“A series of documented allegations were made against the Ag. Chairman of the Economic and Financial Crimes Commission (EFCC). Following a preliminary review of the allegations leveled against the Ag. Chairman and several other members of his staff, there were grounds for a detailed investigation to be conducted.

“Hence, an investigative panel was constituted in compliance with the extant laws governing the convening of such a body.

“As is the proper procedure, when allegations are made against the Chief Executive of an institution, and in this case an institution that ought to be seen as beyond reproach, the Chief Executive has to step down from his post and allow for a transparent and unhindered investigation.

“EFCC does not revolve around the personality of an individual, and as such cannot be seen through the prism of any individual.

“Therefore, the suspension of Mr. Ibrahim Magu, allows the institution to continue carrying out its mandate without the cloud of investigation hanging over its head.

“EFCC has many good, hardworking men and women who are committed to its ideal and ensuring that the wealth of our country isn’t plundered and wherein there is an act of misappropriation such person(s) are brought to justice,” Buhari said, in a statement by his Senior Special Assistant on Media and Publicity, Garba Shehu.

The statement added that the embattled EFCC acting chairman was being given opportunity to defend himself in accordance to the rule of law.

“Mr. Magu is being availed the opportunity to defend himself and answer the allegations against him. This is how it should be, as is the fact that under the laws of Nigeria every citizen is presumed and remains innocent until proven guilty.

“We must realise that the fight against corruption is not a static event, but a dynamic and ever evolving process, in which the EFCC is just one actor; and as we continue to work towards improving our democratic process so shall every institution of ours also embark on that journey of evolution.

“What is however important is that there must be accountability and transparency and our people must realize that they would be held to account. This is the building block in the fight against corruption, the establishment of the concept of Accountability and the recognition of the rule of law.

“Those who see Mr. Magu’s investigation, as a signal that the fight against corruption is failing, have unfortunately, missed the boat.

“There is no better indication that the fight is real and active than the will to investigate allegations in an open and transparent manner against those who have been charged to be custodians of this very system.

“Under this President and Government, this is our mantra and guiding principle. There are no sacred cows, and for those who think they have a halo over their heads, their days are also numbered.

“Mr. Magu was not immune – and regardless of the obvious embarrassment that potential acts of wrongdoing by him, given the office he held, may appear for the government.

“No other administration in the history of Nigeria would have moved to bring into the light and public domain such an allegation,” the statement pointed out.

Meanwhile, the President has urged African leaders to ensure the immediate actualisation of the Common African Position on Assets Recovery (CAPAR), as the continent celebrated Anti-Corruption Day on July 11.

Buhari, in a letter to President of South Africa, Cyril Ramaphosa, Chairman of African Union, asked for a re-commitment to the anti-corruption war by leaders on the continent to engender an “integrated, prosperous and peaceful Africa, driven by its own citizens, representing a dynamic force in the international arena.”

The Nigerian President, in a statement by his Special Adviser on Media and Publicity, Femi Adesina, lamented that “the massive corruption being perpetrated across our national governments has created a huge governance deficit that has in turn created negative consequences that have worsened the socioeconomic and political situation in Africa.”

The letter by Buhari reads in part: “As Your Excellency is aware, the continental fight against corruption has been premised on an irreducible minimum that can pave the way for Africa’s transformation.

“In this effort, the emphasis has been on the continent’s collective determination to forge resilient partnerships among our national governments, civil society organisations and other interest groups, such as women, youth and the physically challenged, to ensure improved socio-economic, political and security development and ultimately, the improvement of our continent.

“The concern of the African Union is that the massive corruption being perpetuated across our national governments, has created a huge governance deficit that has in turn created negative consequences that have worsened the socio-economic and political situation in Africa.

“Your Excellency may recall that these continental concerns led our colleagues at the African Union, to appoint my humble self as the African Union Anti-Corruption Champion. I believe that the efforts and focus of the Nigerian Government at home, partly informed this decision as well as the need for Africa, as a continent, to recommit herself to the fight against corruption and the imperative to free resources for meaningful development.

“I am, therefore, in full support of the call for the issuance of a continental message to commemorate this day, on July 11, 2020, to re-commit the African Union to the continental fight against corruption, including through a robust approach to assets recovery, hence the need for a strategic framework on a Common African Position on Assets Recovery (CAPAR).

“Happily, in February 2020, at the 33rd Ordinary Session of the Assembly of the African Union in Addis Ababa, CAPAR was adopted. In my view, the African Union must go beyond the mere annual celebration of the Africa Anti-Corruption Day by moving swiftly to operationalize the African Common Position on Assets Recovery by all member states. This is an excellent way to drive Africa’s Agenda 2063, for an ‘integrated, prosperous and peaceful Africa, driven by its own citizens, representing a dynamic force in the international arena.’

“As current Chair of our Union, I sincerely commend to you, this suggestion that seeks to call our leaders in Africa to recommit ourselves to this very important task of reclaiming our continent from the vice of systemic corruption.

“Please accept, Your Excellency and Dear Brother, the assurances of my highest consideration.”

You’re unfit to lead an agency like EFCC, PDP condemns Magu

Peoples Democratic Party (PDP) Saturday said the President Muhammadu Buhari-Federal Government must not cover for the indicted Acting Chairman of the Economic and Financial Crimes Commission (EFCC), but ensure that he answers for alleged corruption, reported violation of rules, victimisation of Nigerians and stealing of recovered funds for which he has been suspended.

“What Nigerians expect at this time is for the Federal Government to ensure Magu’s prosecution in court as well as take necessary and decisive steps to restore the integrity of the EFCC by ensuring that Magu’s replacement as EFCC Chairman is thoroughly screened to avoid the ills and violations experienced under the suspended acting chairman,” PDP said.

The party described Magu as not only being unfit to lead an agency like the EFCC, but has also allegedly “reduced the anti-corruption agency to a house of corruption and a partisan witch-hunt organisation that thrives in violation of rules, abuse of investigation processes, manipulation of court procedures as well as a vehicle to harass and extort money from innocent Nigerians.”

The opposition party stated that “Magu should be made to provide answer to allegations in the public space that he was more interested in securing politically induced convictions rather than justice, for which he allegedly turned EFCC into a terror house where innocent Nigerians are harassed with trumped-up charges and convicted on media trial even before being allowed to defend themselves in court.”

The party said: “There are also allegations of violation of rights, including allegedly making his victims to make statements in custody without the services of their lawyers. This is in addition to insinuations in the public that the indicted EFCC boss was also harassing certain judges to get conviction on cases.

“Similarly, there are several cases of officers and ranks of the commission whose employment in the service were unjustly suspended or terminated.”

PDP accused Magu og destroying “the integrity of the anti-corruption agency with his manifest selective fight against corruption, in which no member of the current administration, including those who have been openly indicted for corruption, has been prosecuted by EFCC.”

“Nigerians can recall that under Magu, the former National Chairman of the All Progressives Congress (APC), Adams Oshiomhole, was bold to state that once a corrupt person joins the APC, all his sins are forgiven.

“Moreover, the memo by the Attorney General of the Federation and Minister of Justice, Abubakar Malami, detailing charges of diversion of recovered funds, secret sale of seized property and insubordination among others now validates the position of most Nigerians that Ibrahim Magu lacks the required discipline, exposure and experience to head an agency like EFCC,” the party added.

PDP, in a statement by its National Publicity Secretary, Kola Ologbondiyan, also urged “an investigation into the alleged connection between the indicted EFCC boss and certain judges handling EFCC cases, while calling on the judiciary to sanitise the courts in this direction.”

Magu Probe: Osinbajo requests IGP to investigate N4billion allegations by blogger

Nigeria’s Vice President Yemi Osinbajo has written to the Inspector General of Police damanding investigation into some “vicious and malicious” allegations that he had obtained part of a N39 billion recovered loot in the custody of the Economic and Financial Crimes Commission (EFCC).

The Vice President’s move follows allegations by an online journalist, Jackson Ude, who in an article published in Point-Blank news on the 8th of July alleging that VP Osinbajo collected N4 billion from the suspended EFCC Chairman, Ibrahim Magu.

Vice President Osinbajo, who wrote through his lawyers is asking the Inspector General of Police to conduct full investigation into allegations made by Ude from Point-Blank news.

The blogger had also alleged that embattled Magu is begging for a soft landing from the presidential panel because of the alleged illegal transaction between him and the Vice President.

According to the letter written by Prof. Yemi Osinbajo’s lawyers from the chambers of Bayo Osipitan and Co dated 8th July 2020, Ude’s allegations were described as vicious and malicious meant to portray the vice president as a dishonest and disloyal public officer unfit for the office of the vice president.

The letter called for a thorough investigation into the allegations made by Jackson Ude, noting that if those claims are found to be false, then criminal proceedings for criminal defamation should be brought against Jackson Ude.

Osinbajo’s call comes on the heels of an ongoing probe into the operations of Ibrahim Magu as acting boss of the EFCC.

Magu, who is believed to have been removed from office is spending a fourth day in the custody of the Nigeria Police.

This comes as the presidential panel continues its investigation into the activities of the commission under the leadership of Magu.

The panel is reported to have extended its probe to properties alleged to have been acquired by Magu in Dubai, the United Arab Emirates (UAE).

On Tuesday night, a team of security officials reportedly searched his homes in Abuja and were reported to have left with some documents, although it was not confirmed if anything incriminating was found during the search.

The investigation of Magu followed the allegations of misconduct levelled against him by the Attorney-General of the Federation and Minister of Justice, Abubakar Malami.

Nigeria’s Minister of Justice and Attorney General, Abubakar Malami

Malami, a Senior Advocate of Nigeria, was said to have written to President Muhammadu Buhari, demanding the removal of Magu as the acting chairman of the anti-graft agency.

Meanwhile, the Presidency believes the probe has reinforced the commitment of the Buhari administration to transparency and accountability.

EFCC: DCP Mohammed Umar resumes as Acting Chairman, PDP berates Govt.

A Deputy Commissioner of Police (DCP), Mohammed Umar, has been appointed as Acting Chairman of the Economic and Financial Crimes Commission (EFCC).

The appointment of Umar by President Muhammadu Buhari comes after Ibrahim Magu, who is being investigated for alleged corruption, was suspended.

Recall that the Minister of Justice and Attorney General, Abubakar Malami had In his petition against Magu recommended to the President three candidates to replace the now suspended Acting Chairman, Umar’s choice as Acting Chairman is a deviation from that list.

Mohammed, who, until his appointment, was the Director of Operations at the anti-graft agency, resumed duties yesterday, Wednesday.

The presidential probe panel headed by Justice Ayo Salami, is specifically looking into sundry documents and meeting with persons connected to the case at the Banquet Hall of the Presidential Villa, Abuja.

Reports have it that access to the premises of where the probe panel is sitting was heavily guarded by operatives of the Department of State Services (DSS).

However, the Peoples Democratic Party (PDP) has demanded that the Federal Government immediately begin prosecution of Magu.

The party, in a statement by its National Publicity Secretary, Kola Ologbondiyan, yesterday, observed that the alleged diversion of recovered funds and fraudulent sale of assets seized by the EFCC among other forms of sleaze, as detailed in the memo by the Attorney General and Minister of Justice, as well as the DSS report on Magu’s activities, further exposed the racket that the fight against corruption had become under the All Progressives Congress (APC) government.

It stated that Magu’s indictment reinforced its position that the hyped corruption war by the EFCC under Magu had been a huge scam.

Also, an arm of the party known as the Peoples Democratic Party Youth Alliance (PDPYA) called for immediate resignation of Vice President Yemi Osinbajo for his involvement in the case. Magu, who is under probe on a 22-count charge of fraud, alleged that he gave N4 billion out of the N39 billion he recovered to Osinbajo.

In a release made available to newsmen yesterday, Kalu said the development was clear evidence that the President Muhammadu Buhari administration had only been paying lip service to the corruption fight.

In the same vein, former governor of Ekiti State, Ayodele Fayose, has asked security agencies to tighten the noose around Magu, for him not to escape. Fayose yesterday called on the DSS, the police and other security agencies to place the suspect on the country’s watch list, so that he would not disappear into thin air.

This is just as the Civil Society Legislative Advocacy Centre (CISLAC) called on the panel to be thorough and fair in its investigation. According to the Executive Director, CISLAC, Auwal Musa (Rafsanjani), while it is unclear what the real issues are, “CISLAC is concerned about the conflicting signals it sends to Nigerians. Being that Magu heads a very sensitive position in a government agency tasked with the investigation of financial crimes, it is thus pertinent that the case be handled with all diligence and transparency to ensure that the gains in the fight against corruption are not lost in the battle for supremacy and political advantage.”

EFCC Chair: 3 likely candidates to take over as Magu’s travail persists

As suspended Acting Chairman of the Economic and Financial Crimes Commission (EFCC) gets busy with clearing his name of corruption allegation that bothers on disparities in recovered loots, selling of seized properties to cronies, and insurbordination to the Minister of Justice, three candidates are likely to take over his job.

While there are speculations that Magu already moved out of his official residence, talks about the replacement of a man who spearheaded the process of sending people found guilty of corruption to prison, and now facing the same charges himself have already begun.

Recall that the drumbeat of Magu’s removal began to sound when in June, the Attorney-General of the Federation (AGF) and Minister of Justice, Abubakar Malami (SAN), recommended to President Muhammadu Buhari the sacking of the Acting Chairman of the Economic and Financial Crimes Commission (EFCC), Mr Ibrahim Magu.

Malami didn’t stop at recommending Magu’s sack; he included a list of three candidates for consideration to replace Magu.

As the situation unfolds, Magu’s travails seem to persist, as the presidency’s handling of the investigation was described by a top presidential official as a bold statement that nobody under the Buhari administration is above the law.

EFCC boss, Magu suspended over fraud allegation, SERAP fears powerplay

The embattled Acting Chairman of the Economic and Financial Crimes Commission, Ibrahim Magu, has been suspended by the Presidency pending when a decision will be taken on him.

The anti corruption agency chief was arrested on Monday by a combined team of Department of State Services personnel and policemen at the Wuse II office of the EFCC to face an interagency committee investigating corruption allegations against him.

Echotitbits reported earlier Tuesday morning how the fate of the embattled EFCC Chairman-Magu hangs in balance

He was detained at the FCID in Area 10, Abuja, on Monday night on the orders of the committee that also questioned him on Tuesday morning.

Meanwhile, the Socio-Economic Rights and Accountability Project (SERAP) has expressed “concerns about reports that the apparently arbitrary arrest of the acting chairman of the Economic and Financial Crimes Commission (EFCC), Ibrahim Magu, may be ‘the outcome of power-play’ at the highest levels of government.”

In a statement issued on Tuesday by the Deputy Director of the agency, Kolawole Oluwadare, the organisation said: “The reported statement by a member of PACAC seems to suggest that Magu’s arrest may be politically motivated and aim to undermine the independence and freedom of action of the EFCC. If true, this would make a mockery of Buhari’s oft-repeated commitment to fight grand corruption and the impunity of perpetrators, which is fuelling widespread and systemic corruption in the country.”

Oluwadare, therefore, urged the authorities to afford Magu his constitutionally and internationally guaranteed fair trial rights.

“Magu must either be charged with a recognizable criminal offence or released immediately and allowed to do his job without fear of reprisals,” the statement read in part.

“Nigerian authorities cannot continue to keep Magu in detention under suspicious circumstances without bringing any legitimate charges against him in violation of national and international law.

“Nigerian authorities must support the independence and freedom of action of anti-corruption agencies and institutions if they are to be able to genuinely fight grand corruption, which has for many years turned public service for many into a kind of criminal enterprise.”

“Nigerian authorities should focus on addressing the impact of corruption such as political violence, and denial of access for millions of Nigerians to even the most basic health and education services, as well as other patterns of human rights violations.

“Improving the independence of anti-corruption agencies and institutions is the most promising way to make tangible progress in the fight against corruption now and in the near future.

“Article 9(1) of the International Covenant on Civil and Political Rights and Article 6 of the African Charter on Human and Peoples’ Rights to which Nigeria is a state party guarantee to everyone the right to liberty and security of person, and that no one should be subjected to arbitrary arrest or detention.

“Similarly, Section 35(1) of the Nigerian Constitution of 1999 (as amended) guarantees to every person the right to personal liberty and that no person should be arbitrarily deprived of such liberty.”

Fate of embattled EFCC Chairman, Magu hangs in balance

This is not a good time for the Acting Chairman of the Economic and Financial Crimes Commission (EFCC), Ibrahim Magu, as his fate to continue serving in that capacity hangs in the balance.

After hours of being grilled by the Justice Ayo Salami-led Presidential Advisory Committee Against Corruption (PACAC) on Monday at the Presidential Villa in Abuja, reports said Magu was taken into a “custody” by the operatives of the Force Criminal Investigation Department (FCID) where he faced another round of interrogation.

The interrogations are expected to continue today.

It would be recalled that the Minister of Justice and Attorney-General of the Federation, Abubakar Malami, has been having some running battle with Magu in the last few months.

This led the minister to write an official letter to President Muhammadu Buhari, recommending the sacking of EFCC Acting Chairman.

In the memo to the President, Malami based his recommendation on several grounds “ranging from diversion of recovered loot to insubordination and misconduct” by Magu.

Little wonder, the Salami panel quizzed Magu on Monday over various allegations, including discrepancies in the reconciliation records of EFCC and the Federal Ministry of Finance on recovered funds; declaration of N539 billion as recovered funds instead of N504 billion earlier claimed; and insubordination to the Office of the Attorney-General of the Federation, by not seeking his approval on some decisions.

Other allegations are: Magu’s alleged refusal to provide enough evidence for the extradition of ex-Minister of Petroleum Resources, Diezani Alison-Madueke; deliberate late action on the investigation of Process and Industrial Development (P&ID) leading to legal dispute; non-respect of court order to unfreeze a N7 billion judgement in favour of a former Executive Director of First Bank; deliberate delay in acting on two vessels seized by Nigerian Navy leading to the loss of crude; favouring of some investigators called Magu’s Boys; reporting some judges to their presiding officers without deferring to the AGF; sales of seized assets to cronies, associates and friends; and issuance of investigative activities to some media prejudicial to some cases.

While there were hues and cries over his purported arrest on Monday, a member of PACAC, Prof. Femi Odekunle, rose in defence of Magu, saying “those sent to invite him for whatever reasons best known to them invited some press along and made it look like an arrest.

“That mischief has been confirmed by some apparent afterthought denial by the DSS (Department of State Services) that it was not an arrest,” he said.

Odekunle described his statement as “a preliminary reaction of the Presidential Advisory Committee Against Corruption (PACAC) to the alleged ‘arrest’ of Ibrahim Magu, Acting Chairman the Economic Financial Crimes Commission (EFCC).”

But, PACAC, in a statement on behalf of the committee by its Communications Officer, Aghogho Agbahor, described Odekunle’s press release as his “personal opinion.”

“The attention of the Chairman of the Presidential Advisory Committee Against Corruption (PACAC) has been drawn to a statement circulating in the media space credited to one of its members Professor Femi Odekunle.

“The press release is the personal opinion of the member under whose name it was released and not that of the committee. If the committee consistent with its mandate has any view on the matter, it will be channeled to the President and not to the media,” Agbahor said.

Odekunle, while further defending Magu, explained that the real information was that EFCC Acting Chairman was only invited to appear before a panel “set up not long ago concerning some alleged memo by Malami, regarding some alleged malfeasance by Magu, along with nominations for his replacement.”

According to him, “While PACAC has not had a formal meeting on this development, I have discussed with the Chairman and some other members and the following can be considered as PACAC’s preliminary reaction to this development.

“The alleged originating Malami memo, up to the current ‘arrest’ seems an outcome of power-play by power blocs in the corridors of power in which Malami appears to be an arrow-head or major agent of a power bloc that is not really interested in, or in support of, Buhari’s anti-corruption fight.

“One can recall the earlier non-confirmation experience of Magu by the 8th Assembly, orchestrated by a power bloc and supported by the DSS ‘Security’ reports.

“One can also note the non-resubmission of Magu for confirmation since May, 2019 despite the apparent willingness of the 9th Assembly to consider it this time around.

“Furthermore, one must take cognisance of the alleged memo referred to earlier i.e by Malami concerning alleged corrupt practices by Magu, along with his own nominations for Magu’s replacement.

“Again, we cannot forget Malami’s demand of certain high profile case files from Magu which the latter has been resisting.

“The position of PACAC is that while Magu, or any official of whatever status, must be nailed if found to be corrupt, the President must be careful not to shoot its anti-corruption fight /modest achievements in the foot, and not to forget that EFCC under Magu has been the Administration’s anti-corruption poster-face.

“It may not be contestable that Malami has been exploiting his alleged loyalty and closeness to the President for his personal /power bloc agenda.

“For, to the best of PACAC’s knowledge and observations, Malami has not manifested any genuine commitment to the anti-corruption fight. Samplers: The nolle- prosequi entered in a case of corruption against Orubebe in relation to alleged malfeasance while Minister of Niger Delta Ministry; his secret meeting with fugitive Maina in Dubai under whatever guise/ excuse; his involvement in the surreptitious reinjection of the same Maina into the Civil Service; his supervision of Obono-Oblas’ kangaroo Asset Recovery outfit which Obono subsequently ran out of the country when exposed by some ICPC investigation; his non-due attention, by design or default, to the P&ID matter since 2015 until it was blown open by humongous financial damage to the country; etc.

“Notwithstanding the situation at hand, the hope of PACAC is that the President would wake up to the ongoing shenanigans of power players that are working from the inside against his anti-corruption fight. We are also counting on the experience and dexterity of the new Chief of Staff, Professor Ibrahim Gambari whose loyalty to the President and good of the country cannot be doubted, and we also hope that the demonstrated integrity of retired Justice Salami would carry the day for thoroughness, fairness and justice in the interest of the anti-corruption fight.”

From all indications, Magu may be forced to step down as the EFCC Acting Chairman. For now, the intrigues and power play continue over Magu’s replacement.

EFCC: Adeherself, ‘internet fraud picker’ and Social media influencer, charged to court

A self-acclaimed social media influencer, Adedamola Adewale Rukayat, also known as Adeherself has been arraigned by the Economic and Financial Crimes Commission (EFCC) before Justice Sherifat Solebo of the Special Offence Court sitting in Ikeja, Lagos on one-count charge of possession of fraudulent documents.

In a statement Tuesday morning, the EFCC Tuesday, the defendant was arrested following intelligence received by the Commission on the activities of some young men allegedly involved in internet fraud in the Lekki axis of Lagos State.

The count read: “That you, Adewale Adedamola Rukayat, on or about the 15th day of June, 2020 in Lagos, within the jurisdiction of this honourable court, with intent to defraud, had in your possession documents titled “WhatsApp”, which representations you knew or ought to have known, was false and thereby committed an offence contrary to Section 6 (8)(b) and 1 (3)(d) of the Advance Fee Fraud and Other Fraud Related Offences Act No. 14 of 2006”.

Adewale however, pleaded not guilty to the charge. In view of her plea, prosecution counsel, S.O. Daji, asked the court for a trial date and also prayed that she be remanded in the custody of the Nigerian Correctional Service (NCS).

The defence counsel informed the court of a bail application for his client and also prayed for a short date to enable its hearing.

Justice Solebo adjourned the matter to July 13, 2020 for hearing of the bail application and also ordered the defendant to be remanded in the EFCC custody.

In June, Adeherself, 20, and her accomplice, Lamina Hamzat Ajibola were arrested for internet fraud at the Agungi area of Lekki, Lagos State.

Their arrest was said to be sequel to intelligence linking them to online fraudulent activities with two brothers, Lasisi Wasiu Adeleke and Lasisi Riliwan Adeniyi, who are at large.

“They were arrested at a four-bedroom duplex belonging to the two run-away fraudsters,” EFCC said.

The antigraft body said during interrogation, Adewale (Adeherself) confessed to being a ‘picker’ in cyber fraud.

The commission said the model usually posed as a lady to hoodwink her foreign “preys”.

EFCC listed items recovered from the suspects to include two Toyota Camry 2009 model cars, and a sum of N9,000,000.00 (Nine Million Naira only), which was found in Adewale’s account.
